Welcome to RockFit. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and KYMEA Studio ("we", "us", or "our"), governing your access to and use of the RockFit mobile application for iOS (the "App") and related services.
By downloading, installing, or using RockFit, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the App.
1. Product Description & Architecture
RockFit is a personal strength training, workout tracking, and program periodization application. The App provides tracking utilities (workout logs, rest timers) and local algorithmic features that generate workout routines and training suggestions.
Local Execution & Privacy: RockFit operates primarily as an on-device experience. Workout logs and algorithmic routines are processed locally on your device. Any optional backup or cross-device data synchronization relies on your private Apple iCloud account (CloudKit). KYMEA Studio does not operate external database servers storing your personal workout logs.
2. Medical and Health Disclaimer (Assumption of Risk)
ROCKFIT IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.
- Informational Purpose Only: All workout routines, exercises, sets, repetitions, weights, and periodized training plans generated by the App or its algorithmic models are provided strictly for educational and entertainment purposes. They do not constitute personalized medical, physical therapy, or healthcare instructions.
- Physician Consultation Required: Strength and resistance training involve inherent physical risks. You should consult a physician or qualified healthcare provider before beginning any new exercise routine, particularly if you have pre-existing cardiovascular, musculoskeletal, or metabolic conditions.
- Personal Responsibility: You perform all exercises and workouts voluntarily and entirely at your own risk. It is your sole responsibility to ensure appropriate lifting technique, suitable equipment, and adequate physical recovery.
- Limitation of Health Liability: To the maximum extent permitted by applicable law, KYMEA Studio disclaims any and all liability for bodily injury, physical harm, illness, muscle damage, or incidental damages resulting directly or indirectly from the execution of workouts suggested or tracked through the App.
3. Subscriptions and In-App Purchases (RockFit Pro)
RockFit provides core features free of charge and premium capabilities through RockFit Pro. Purchases are processed exclusively through Apple's In-App Purchase system.
Available Tiers
- Monthly Subscription: Billed on a recurring monthly basis.
- Annual Subscription: Billed on a recurring yearly basis, which may include an introductory 7-day free trial where indicated.
- Lifetime Purchase: A one-time, non-recurring payment providing lifetime access to Pro features.
Billing and Renewal Terms
- Payment: Payment will be charged to your Apple ID / iTunes Account at the confirmation of purchase.
- Auto-Renewal: Auto-renewable subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing cycle. Your account will be charged for renewal within 24 hours prior to the end of the current period at the original purchase price.
- Managing & Canceling: You can manage or turn off auto-renewal at any time in your device’s Apple ID Account Settings after purchase.
- Free Trial Forfeiture: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.
- Refunds: All purchases and refund requests are governed by Apple Media Services Terms and Conditions. KYMEA Studio does not possess the technical or legal ability to issue direct refunds; all refund claims must be addressed directly to Apple Customer Support.
4. Apple HealthKit Integration
RockFit may offer optional integration with Apple Health (HealthKit) to write completed workout sessions and metrics. Access to HealthKit is strictly optional, requires your explicit operating system consent, and can be revoked at any time within the iOS Health settings. KYMEA Studio does not export, sell, or disclose HealthKit data to third parties or advertising brokers.
5. Intellectual Property Rights
The App, its underlying codebase, user interfaces, Liquid Glass visual motifs, graphics, algorithms, and the RockFit and KYMEA Studio trademarks are the exclusive property of KYMEA Studio and Julien DLUBALA. You receive a limited, non-exclusive, non-transferable, revocable license to use the App on iOS devices that you own or control, in accordance with the Apple App Store Usage Rules.
6. Disclaimer of Warranties & Limitation of Liability
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. KYMEA Studio does not warrant that the operation of the App will be uninterrupted, error-free, or compatible with all operating system releases.
To the fullest extent permitted by law, KYMEA Studio shall not be liable for any indirect, punitive, incidental, special, or consequential damages resulting from your use or inability to use the App.
7. Governing Law and Severability
These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be severed, and the remaining provisions will continue in full force and effect.
